Wills, Probate, Tax and Trusts

Sadly, death is a fact of life. Whether you are dealing with the death of someone close to you, or making plans for your own eventual death, we can help to make the process easier for you.

Dealing with the death of someone else

Making arrangements after a death can be daunting. A good funeral director will be invaluable and will guide you through all the arrangements, but soon after that you face the issue of financial matters. There is a great deal to do and it can often be overwhelming. This is where we can help. Our Probate Department will lead you through the procedures with sensitivity and skill. Making your own plans

Planning for your own death may seem morbid but it’s vital. If you die without a valid will (intestate) your possessions may not go where you want them to, so the first essential step is to make a will. We can take you through this process at a reasonable cost. We will also ensure that your affairs are organised so that you will pay no more tax than is necessary. Power of Attorney

Sometimes a person is no longer able to take care of their own affairs. If you have given a trusted friend or relative a power of attorney they can then make sure that all your needs are provided for; if not it can get very complicated and the court has to be involved.

We can advise and take care of this, either for you or for a relative or friend. For more information on powers of attorney and Court of Protection matters please click here.

Trusts

Trusts are a way of protecting assets, which can consist of almost anything including money, in a ring-fenced, managed way, with trusted people of your choice (Trustees) in control. For more on trusts click here.

Tax Planning

We can work closely with you and your financial advisor or accountant to reduce the tax liability. We will give expert, practical advice, tailored to your circumstances on the following:

  • Putting in place tax efficient Wills
  • Passing down assets to your children or other beneficiaries during your lifetime
  • Post-death variations of Wills to incorporate more tax efficient provisions
  • Utilising your exemptions and reliefs
  • Mitigating Capital Gains Tax on assets you wish to dispose of
