Serving Possession Notices

Considering your tenancy documentation, advising you in writing and preparation and service of notices on your tenant. This work is based 2 -3 hours associate /assistant solicitor time and includes pre-action correspondence with you, pre-action correspondence to your tenant, drafting the notice(s), serving the notice(s) and reporting to you.

Section 21 Notice – £250 plus VAT and disbursements*
Section 8 Notice – £350 plus VAT and disbursements*

Issuing Possession Proceedings

Accelerated possession proceedings (Section 21): £1,000 plus VAT & disbursements (court fee, currently £355)*

The work is based on uncontested proceedings and on 7 hours associate /assistant solicitor time and includes drafting and filing the court proceedings, preparing a hearing bundle and preparing for a Review Hearing.

Standard possession proceedings (Section 8 and/or Section 21)- £1,450 plus VAT & disbursements (court fee, currently £355)*

The work is based on uncontested proceedings and is based on 10 hours associate /assistant solicitor time and includes drafting and filing the court proceedings, preparing a hearing bundle, preparing for Review Hearing and attending any uncontested Possession Hearing.

Recovery of your costs

Recovery of costs only becomes applicable once court proceedings are issued and costs are always at the discretion of the court. If the possession proceedings are undefended and an order is made for possession, the court will generally only order the tenant to pay fixed costs together with the court issue fee. Fixed costs are capped by the court and are under £100. Our charges payable by you are calculated on a time basis in accordance with our estimate and will exceed the fixed costs allowed by the court.

If the possession proceedings are defended, the court will use the hearing to give case management directions. Where the claim is genuinely disputed on grounds which appear to be substantial, the case management directions will include the allocation of the claim to a ‘Track’ (usually the Fast Track or the Multi-Track) and directions of the defended claim will be ordered to trial.

IMPORTANT TERMS

  1. Our charges do not include costs associated with the following work and our usual hourly rates will apply as set out in our terms and conditions of business:
    1. Defended Possession Proceedings
    2. Any additional advice(s) given to you at your request in respect of the matter(s);
    3. Any communications/correspondence with you, the tenant and/or any third parties in connection with (1) any issue or dispute raised by the tenant, (2) further enquiries, (3) your further instructions and (4) any settlement negotiations relating to the matter(s);
    4. The attempted collection and/or the collection of any payments and/or instalments and associated communications/correspondence with the debtor/other third parties;
    5. Interim applications made by you or the other side; and
    6. Any appeal made by you or the other side.
  2. If for reasons beyond our control or upon your instructions, any Court application is adjourned, any process of enforcement cannot be served upon the tenant in the first instance or any court order is suspended, we reserve the right to be paid additional charges based upon our usual hourly rates set out in our terms and conditions of business.
  3. All instalments of any money judgment whether by court order or otherwise will be collected by you and if you require us to collect any instalments due to you, our usual hourly rates will apply as set out in our terms and conditions of business.
  4. Agency or Counsel fees will be charged in addition. You will be notified of those charges and payment of any such charges must also be made in advance of instructions to the particular agent/counsel. We reserve the right to instruct agents or Counsel for any representation.
  5. Travel fees are 45 pence per mile plus parking fees or taxi/train fares. VAT is payable on travel fees.
  6. We reserve the right to refuse any instructions at any time and instructions may be terminated if you fail and/or refuse to provide us with full and proper instructions together with all relevant documentation. If instructions are terminated either by you or by us, you will be liable for payment of the estimated charges and our hourly rates will apply as set out in our terms and conditions of business.
